1. Acceptance of Terms

These Terms of Service (these "Terms") govern your access to and use of libertyprecisionmachine.com and all related pages, content, products, and services (collectively, the "Services") operated by Liberty Precision Machine LLC ("LPM," "we," "us," or "our"), a federally licensed firearms manufacturer (FFL/SOT) located in Dickinson, North Dakota. The Services are powered by Shopify.

By accessing the Services or placing an order, you ("you" or "Customer") agree to be bound by these Terms and by the following policies, each of which is incorporated into these Terms by reference: the Privacy Policy (/policies/privacy-policy), the Refund Policy (/policies/refund-policy), the Shipping Policy (/policies/shipping-policy), and the Limited Lifetime Warranty (/pages/warranty) (collectively, the "Policies"). If you do not agree to these Terms, you may not access or use the Services.

2. Eligibility and Accounts

2.1 You must be at least twenty-one (21) years of age to access the Services or make a purchase. By accessing the Services, you represent and warrant that you are at least twenty-one (21) years of age and are legally permitted to possess the products you order in the jurisdiction in which you reside.

2.2 You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted under your account. You may not transfer, sell, or assign your account to any other person.

3. Firearms and NFA Compliance

3.1 Silencers are regulated under the National Firearms Act, 26 U.S.C. § 5801 et seq. (the "NFA"). Except as otherwise permitted by law or court order, each silencer transfer requires an approved ATF transfer form and must be processed through a federally licensed dealer. You may not take possession of a silencer until the applicable transfer has been approved.

3.2 At checkout, you must select either "Ship to My Preferred Dealer" or "Ship to My Door via Capitol Armory." For dealer orders, you must email your dealer's contact information and your order number to info@libertyprecisionmachine.com within forty-eight (48) hours of purchase. For Capitol Armory orders, Capitol Armory acts as the transferring dealer, and its terms and conditions shall also apply.

3.3 Transfer processing times are determined by the ATF and your dealer. LPM shall not be liable for delays beyond its reasonable control.

3.4 You are solely responsible for knowing and complying with all federal, state, and local laws applicable to the purchase, ownership, possession, transportation, and use of the products you order, including muzzle devices. Certain states and localities prohibit or restrict silencers or certain muzzle devices.

3.5 LPM does not sell silencers to residents of jurisdictions in which civilian ownership is prohibited, which currently include California, Delaware, Hawaii, Illinois, Massachusetts, New Jersey, New York, Rhode Island, and the District of Columbia.

3.6 LPM may cancel and refund any order prior to shipment if LPM reasonably believes that the order cannot be lawfully completed, including where the purchaser appears to be prohibited from possessing the item.

3.7 LPM maintains firearms transaction records as required by federal law. Such records will not be deleted upon request.

3.8 LPM ships only to addresses within the United States. LPM's products are subject to U.S. export control laws and may not be exported without appropriate authorization.

3.9 The NFA and ATF procedures are subject to change, including by judicial decision. LPM will follow the procedures in effect at the time your transfer is processed.

4. Products and Specifications

4.1 LPM endeavors to describe its products accurately. Listed weights and dimensions are nominal and may vary due to manufacturing tolerances. Colors displayed on your screen may differ from actual product colors.

4.2 You must use each product only within its published ratings and in accordance with the LPM Master Installation Manual, and must confirm bore alignment before firing.

4.3 LPM reserves the right to modify or discontinue any product, and to limit quantities, at any time without notice.

4.4 Rearden MFG adapters and mounts sold by LPM are covered by the LPM Limited Lifetime Warranty, and LPM shall administer all warranty claims for such products. All other third-party products are subject solely to the warranties, if any, of their respective manufacturers.

5. Orders

5.1 Your submission of an order constitutes an offer to purchase. LPM may accept or decline any order in its sole discretion. An order is accepted only when LPM confirms the order and processes payment.

5.2 LPM may cancel any order due to pricing or listing errors, suspected fraud, legal or compliance concerns, or the inability to complete an NFA transfer. If LPM cancels an order, LPM shall refund all amounts paid for the cancelled items.

5.3 Retail purchases are for personal use only. Purchases by dealers and distributors are governed by LPM's separate dealer terms, and the personal-use restriction in this Section 5.3 shall not apply to approved dealer accounts. Prospective dealers may apply through the Dealer Request page.

6. Prices and Payment

Prices, discounts, and promotions are subject to change without notice. You agree to pay the price in effect at the time your order is placed, together with applicable shipping charges and taxes. In the event of a conflict between the terms of a promotion and these Terms, the terms of the promotion shall govern with respect to that promotion. You represent and warrant that your payment information is accurate and that you are authorized to use the payment method provided.

7. Gift Cards

Gift cards do not expire and are not redeemable for cash except as required by applicable law. LPM is not responsible for lost or stolen gift cards.

8. Shipping and Delivery

Delivery dates are estimates only. Shipping is governed by the Shipping Policy. Silencers will be shipped only to your designated dealer or to Capitol Armory, and only when permitted by applicable transfer requirements. Title and risk of loss pass to you, or to your dealer in the case of silencers, upon delivery of the package to the carrier.

9. Returns

All silencer sales are final, and silencer orders may not be cancelled once placed. Other products may be returned in accordance with the Refund Policy. Claims for defective products must be made under the Limited Lifetime Warranty and are not governed by the Refund Policy.

10. Warranty

Products manufactured by LPM, and Rearden MFG adapters and mounts sold by LPM, are covered by the LPM Limited Lifetime Warranty, which constitutes LPM's sole express warranty. Nothing in these Terms limits such warranty or any implied warranty applicable to such products under applicable law. TO THE EXTENT PERMITTED BY LAW, MERCHANDISE, GIFT CARDS, OTHER THIRD-PARTY PRODUCTS, AND THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

11. Safety and Assumption of Risk

Firearms and firearm accessories are inherently dangerous. Improper installation, misalignment, or misuse may result in serious bodily injury, death, or property damage. Suppressed firearms remain loud, and hearing protection is strongly recommended, particularly when using a Muzzle Brake End Cap (MBEC). You assume full responsibility for the safe handling, installation, and use of all products.

12. Intellectual Property

The Services and their contents, including LPM's names (Liberty Precision Machine, LPM, Anthem, Mach, Torch, Spark, DUTY, COMP, Eclipse, Liberty Bell, and Baby Bell), logos, text, images, video, and designs, are owned by LPM or its licensors and are protected by United States intellectual property laws. You may use the Services solely for personal, non-commercial purposes. You may not reproduce, distribute, modify, or republish any material from the Services without LPM's prior written consent. Certain LPM products incorporate patented technology. Shopify's name and marks are the property of Shopify. All other names and marks are the property of their respective owners.

The Services may include tools, content, or links provided by third parties. LPM does not control and is not responsible for such third-party tools, content, or websites. Your use of them is at your own risk and is subject to the applicable third party's terms.

14. Relationship with Shopify

Liberty Precision Machine is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Liberty Precision Machine. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Liberty Precision Machine, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Liberty Precision Machine.

15. Privacy

All personal information collected through the Services is subject to the Privacy Policy (/policies/privacy-policy), and certain personal information may be subject to Shopify's Privacy Policy. Because the Services are hosted by Shopify, information you submit is shared with Shopify and with third parties that assist LPM in providing the Services.

16. Feedback and Reviews

If you submit feedback, ideas, or reviews to LPM, you grant LPM a perpetual, worldwide, royalty-free license to use, reproduce, modify, and publish such submissions for any purpose. You represent and warrant that you have the right to provide such submissions, that they are accurate, and that they do not infringe the rights of any third party. LPM may remove any submission in its sole discretion.

17. Errors and Omissions

The Services may contain errors in product descriptions, pricing, availability, or shipping times. LPM reserves the right to correct any error, to update information, and to cancel any order affected by an error at any time, including after an order has been submitted.

19. Termination

LPM may suspend or terminate your access to the Services at any time without notice. You shall remain liable for all amounts owed. Provisions of these Terms that by their nature should survive termination shall survive termination.

20. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LPM AND ITS OWNERS, EMPLOYEES, AGENTS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, OR DATA, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT. TO THE FULLEST EXTENT PERMITTED BY LAW, LPM'S TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM. Nothing in these Terms limits any liability that cannot be limited under applicable law, including liability for death or personal injury caused by LPM's negligence where such limitation is prohibited. Some states do not allow the exclusion or limitation of incidental or consequential damages, so some of the above limitations may not apply to you.

21. Indemnification

You agree to indemnify, defend, and hold harmless LPM, Shopify, and their respective affiliates, officers, employees, and agents from and against any claims, losses, liabilities, and reasonable attorneys' fees arising from your breach of these Terms, your violation of any law or third-party right, or your misuse of any product.

22. Governing Law and Venue

These Terms shall be governed by the laws of the State of North Dakota and applicable federal law, without regard to conflict-of-law principles. Any dispute arising from or relating to these Terms or the Services shall be resolved exclusively in the state courts located in Stark County, North Dakota, or in the United States District Court for the District of North Dakota. You and LPM consent to the personal jurisdiction of and venue in such courts.

23. General Provisions

23.1 Severability. If any provision of these Terms is held unenforceable, the remaining provisions shall remain in full force and effect.

23.2 Waiver. LPM's failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

23.3 Entire Agreement. These Terms and the Policies constitute the entire agreement between you and LPM with respect to the Services and supersede all prior agreements and versions.

23.4 Assignment. You may not assign these Terms without LPM's prior written consent. LPM may assign these Terms without notice.

23.5 Headings. Section headings are for convenience only and shall not affect interpretation.

23.6 Amendments. LPM may amend these Terms by posting a revised version on this page. Your continued use of the Services after such posting constitutes acceptance of the amended Terms.
